Open Eyes 027 Supreme Court To Decide President Above The Law

The Supreme Court is deciding if the President is above the law.  Will they do it?

My thought is, yes.  See why, here on this episode.

It was announced this week that the Supreme Court of the United Staes will be deciding a case, one which will determine if the President of the United States can ever ignore parts of the law in the course of his duties as President.

The case actually involves George W Bush’s presidency, but, depending on the outcome of the case, it will significantly impact any and all future presidents, as well as the very future of the United Sates.

It will also touch on the foreign policy of the US, and it’s stance on the state of Jerusalem.

The case is Zivotofsky vs. Kerry and involves a boy that was born in Jerusalem to American parents. At the heart of the issue that the Supreme Court will be dealing with is whether or not a President can issue signing statements at a bill signing, stating that they will not abide by a particular law or provision in a law.

The Foreign Relations Authorization Act was passed by Congress in 2002. It included a provision that said that children born of American parents in Jerusalem would have the right to state that the child’s birth place was Israel on their passports.

Bush did sign the bill, but also included a signing statement saying that he would not honor said provision because it “impermissibly interferes with the president’s constitutional authority to conduct the nation’s foreign affairs and to supervise the unitary executive branch.””

In October of 2002, Manechem Zivotofsky was born in Jerusalem. His parents asked the US Consulate there to allow them to mark his place of birth as Jerusalem, because the parents have a strong sense of identification with the state of Israel, and wanted it reflected on their son’s birth certificate.

The consulate denied the request, saying that it would violate their policy of neutrality on the status of Israel and Palestine’s argument over Jerusalem.

Now the case is going before the Supreme Court. Obama administration attorneys argue that the president must have control of sensitive foreign policy matters.

In their brief to the Supreme Court, the administration stated, ” The president has exclusive authority to recognize foreign governments … as well as their territorial limits.”

They also said that Congress ” “override the executive branch’s decades-long policy of neutrality with respect to the sovereignty over Jerusalem.”

The irony of all of this is that presidents before Bush had issued signing statements before, but then-senator Obama lambasted Bush for doing them, saying that they overreach executive power and that they cannot pick and choose which parts of the law they want to enforce.

I’m going to say, in regards to all of this, first and foremost, whee in the Constitution does it give the executive branch the right to legislate from the office?

As far as I have read, and i have read it all, the Constitution clearly states that the executive branch is the enforcers of the laws that the legislative branch creates.

Correct?

Am I wrong on that one?

So how exactly, and when, did the executive branch gain this power?

Next, shouldn’t this be : “Supreme Court to decide whether or not the president is above the law.”?

That the Supreme Court apparently doesn’t already know the answer to this is very telling and disturbing.

So if they decide yes, then another President can order the EEOC to take a 4 year vacation, or the EPA, or the ATF… How about tax law.. can the president order the IRS to ignore the taxes of certain favored individuals or corporations? The president can already make up law, by ordering executive agencies to execute regulations that have the force of law.

What do we really need congress for anyway? Just something to appease the masses so they think they have some kind of f^&#ing say in the federal leviathan?

I mean, seriously, people, what the hell is going on in this country?

I know, I know. We don’t actually have any “control” over things, right?

wrong.

We DO have control over things. And it’s not through voting. It’s through using the power that the constitution grants us.

You see, I think they forget that there is a little section in the Declaration of Independence:

That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness. Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shewn, that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed. But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security.

But, you see, there are a lot of changes going on.

There are a lot of school districts that are now no longer really TEACHING these things.

When I was growing up, these things were talked about. They were spoken of, almost with reverence at times.

These are our rights. They are not even just our rights. They are our DUTY, as citizens of the United Sates. They are a duty not even to that.

They are a duty to our future generations.

But they are no longer really teaching that.

They are no longer really teaching that the United States was formed because we were a bunch of very ticked off people, going to war with the British Empire over the exact same things that the American Government is now doing to us.

They no longer really teach that.

They no longer really teach the children of the future that there were once people, called the Founding Fathers, that had a lot of ideas about freedom and the rights of all men to be equals.

And even though those Founding Fathers had a lot of problems themselves (don’t get me started on those, please), they also had a lot of good ideas, and they set them out in these little documents. These little breadcrumbs of truth.

30 years ago, 50 years ago, even 100 years ago, these things were being taught, and “patriotism” ruled the day.

Of course, there was a lot of propaganda that went with that, but the point is the same.

We don’t see the children being taught these things now. Oh, sure, they will talk a ittle about it. But it’s glossed over quite quickly, if spoken about at all.

It’s truly saddening.

So, here we are today, with the President legislating from the Executive branch, ignoring the laws that congress has passed, by doing these little “signing statements” or, Executive Orders.

Oh yes, those things contain quite a few pretty little nuggets of crapping all over the constitution and the laws that are supposed to rule this land.

The presidents just love those executive orders.

10995 — Federal seizure of all communications media in the US10997 — Federal seizure of all electric power, fuels, minerals, public and private.
10998 — Federal seizure of all food supplies and resources, public and private and all farms and equipment (including what you are storing for emergencies in your home right now). 
10999 — Federal seizure of all means of transportation, including cars, trucks, or vehicles of any kind and total control over all highways, seaports and water ways.
11000 — Federal seizure of American people for work forces under federal supervision, including the splitting up of families if the government so desires (this happened before in Europe during the Nazi regime).
11001 — Federal seizure of all health, education and welfare facilities, both public and private.
11002 — Empowers the Postmaster General to register every single person in the US.
11003 — Federal seizure of all airports and aircraft.
11004 — Federal seizure of all housing and finances and authority to establish forced relocation. Authority to designate areas to be abandoned as “unsafe,” establish new locations for populations, relocate communities, build new housing with public funds.
11005 — Seizure of all railroads, inland waterways and storage facilities, both public and private.
11051 — Provides FEMA complete authorization to put above orders into effect in times of increased international tension of economic or financial crisis (FEMA will be in control in case of “National Emergency”).

And these are just a few of the many, many Executive Orders that are now sitting there, ready to be used.

And now we have the Supreme Court, deciding on whether the president can just consider himself above the law entirely, crapping all over the Constitution and placing himself as the Tyrant in Chief.

Don’t think he won’t do it, either. He gets way too much pleasure out of playing golf at the public’s expense to do otherwise.

If the president can pick and choose what parts of legislation he wants to enforce, than so can I.

So can you. So can anyone.

I mean, if I decide that I want to have four wives and sport a big old joint while walking down main street, why not?

If I want to just skip paying my taxes for the next, oh, ever… why not?
If he is above the law, we all are.

Hell, corporations are already above the law, so why not the people, too, yeah?

The corporations, according to the Supreme Court, have as much rights as the citizens do, apparently.

I don’t know, people. The whole situation stinks.

We really need to make some changes. Where to start?

That, I don’t know, either. I have given some ideas out, but it seems that people are more concerned about The Walking Dead than the fact that we’re Walking into the Fire here.

Maybe that’s the point?

We;ve been changed, somehow, and I am not sure where that change began, or where it’s taking us, but it is there. There is no denying that.

Especially for those of us that grew up in the 70s and 80s. We have seen what changes have occurred as we grew up.

And now that we’re middle-agers, we are seeing even more changes happen to our kids.

Maybe it’s the GMOs they put in our foods, or something in the chemtrails in the air. Maybe it’s all designed to make us more docile, more lazy, more apt to not notice when a hand is reaching up our collective bungholes.

I mean, they just released a study showing how our genetic makeup is changing at a more rapid pace now than it ever has. You wonder why that’s happening?

Take a look at what we are eating, what we are breathing, what we are being injected with at an alarmingly increasing rate.

It’s all there to see.

The education system does not educate. The justice system is not just. The religious institutions are as far away from spiritual as you can get.

We’re in a world of opposites here.

And while the fun house mirrors are fun to look at for a while, they can really start making you sick when they start warping.
